Our mission is mandated by Army Europe Regulation 27-9, Legal Services, Misconduct by Civilians. It establishes policy and procedures for responding to misconduct by persons (excluding active duty military) who are eligible to receive individual logistic support from the various U.S. military commands in Europe and are permitted to use military installations facilities.
The United States Army Garrison Benelux (USAG Benelux) CMAA program coverage extends to all U.S. civilians receiving U.S. logistical support in the USAG Benelux footprint regardless of their command sponsorship status. It provides fair and meaningful adjudication of civilian misconduct. When misconduct occurs, CMAA may take certain administrative actions (this may be in addition to the host nation adjudication). If criminal prosecution is warranted, jurisdiction over civilians during peacetime rests with the host nation authorities.
Definition of Misconduct
Conduct or behavior by persons subject to this regulation that violates or is inconsistent with the standards of host nation laws; the United States Code; or the rules, regulations, and other directives of military authorities. Also included is disorderly conduct; conduct prejudicial to good order, discipline, or accomplishment of the mission; truancy; or conduct contrary to directions of persons exercising police authority of a commander.
Examples of Misconduct
Shoplifting; larceny; fighting and assault; damage to property; drunk and disorderly conduct; unauthorized use or possession of a controlled substance; driving while intoxicated; vehicle and traffic violations; child neglect; spousal abuse; truancy; misuse of ration card, purchase, or postal privileges; and others.
Examples of Administrative Actions
Counseling, letter of warning, suspension or revocation of logistic support privileges (AAFES; commissary; moral, welfare, and recreation activities, U.S. Army club privileges, check cashing, government quarters, ration privileges, etc.), suspension of POV driving privileges on USAREUR installations, bar from entry to the installation or all European DOD facilities, advance return of family members, curtailment of tour, and removal from host country.
